Summary of Original Version | Create a new section of KRS Chapter 205 to define "breach of a contract"; provide that if any breach of a contract occurs or has occurred between a Medicaid managed care organization and any agency, department, or cabinet of the Commonwealth, then services to the Medicaid members served under the contract shall immediately cease and members shall be transitioned to a Medicaid fee-for-service program; clarify that any provider of services who is due funds as a result of a contract between a Medicaid managed care organization and the Commonwealth shall still be able to recover them; exempt any Medicaid managed care organization operating in the Commonwealth pursuant to a Section 1115 waiver on January 1, 2011; EMERGENCY. |
