Summary of Original Version | Amend KRS 315.400 to exclude "interpharmacy medication exchange" from the definition of "wholesale distributor"; amend KRS 205.6312 to state that the copayments for a prescription or over-the-counter drug shall be $1 for generic drugs, $2 for preferred brand name drugs, and $3 for non-preferred brand-name drugs; state that these copayments shall not be deducted from a reimbursement due from a Medicaid or a Medicaid managed care organization, but shall be in addition to such reimbursement; state that the copayment requirements shall apply to all Medicaid managed care organization contracting with the cabinet unless the organization charged and deducted the copayment from reimbursement on January 1, 2012; provide that the copayment requirements shall not apply to a Medicaid managed care organization participating in a Section 1115 Waiver Demonstration Project in accordance with Section 1115 of the federal Social Security Act; EMERGENCY. |
