Summary of Original Version | Create new sections of KRS Chapter 454 to provide definitions and establish procedures for dismissing legal actions filed in response to a party's exercise of free speech, right to petition, or right to association; allow for an immediate appeal as a matter of right; allow for costs to be awarded to the moving party if dismissal is granted; allow for costs to be awarded to responding party if the motion was found to be frivolous or filed with the intent to delay; provide that this Act may be cited as the Uniform Public Expression Protection Act. |

Summary | Retain original provisions; amend KRS 199.896 to provide that the license or certification of a child-care center shall not be refused or revoked for refusing to require facial coverings; amend KRS 199.898 to provide that parents and guardians of children enrolled in licensed, certified, or publicly funded child care facilities have a right to refuse facial coverings on behalf of their children without any retribution; create a new section of KRS Chapter 158 to prohibit requiring facial coverings on any public school premises, on school-sponsored transportation, or at a school-sponsored event; create a new section of KRS Chapter 164 to prohibit requiring facial coverings on property owned, leased, or operated by public postsecondary education institutions; provide exceptions for healthcare licensing board requirements imposed prior to January 1, 2020, and clinical research settings; create a new section of KRS 344 to define "immunization status" and "public entity"; establish requirements for a public entity related to employee immunization status; create a new section of KRS 446 to establish a private cause of action related to an employee whose religious beliefs have been violated related to documenting proof of immunization status; EMERGENCY. |
