Summary of Original Version Create a new section of subchapter 20 of KRS Chapter 224 to define terms; require that beginning June 1, 2023, owners or operators of facilities permitted as air contaminant sources shall not use trichloroethylene (TCE) subject to exceptions and time extensions for small businesses; allow the permitting agency to require additional information and impose additional restrictions based on impacts from nearby sources or background concentrations; require that any replacement chemical for TCE be less toxic to human health, as approved by the secretary for the Energy and Environment Cabinet; allow for mandatory and permissive exceptions to the TCE prohibitions based on certain criteria; require the Energy and Environment Cabinet promulgate administrative regulations on or before January 1, 2023 to carry out the requirements of the section, including establishing health risk limits for TCE concentrations in the air and drinking water; create a new section of KRS Chapter 338 to require that after January 1, 2023, employers at workplaces where employees may be exposed to TCE post warnings about the dangers of TCE exposure.
