Summary Retain original provisions and amend KRS 315.036 to delete references to wholesalers; create new sections of KRS Chapter 315 to define terms including authorized distributor of record, counterfeit prescription drug, drop shipment, emergency medical reasons, end user, manufacturer, normal distribution channel, pedigree, third party logistics provider and wholesale distributor; require a wholesale distributor to be licensed by the board; specify conditions for a wholesale distributor to receive prescription drugs and require a manufacturer or a wholesale distributor to supply drugs only to a person licensed to possess or distribute drugs to an end user; require any wholesale distributor to provide a pedigree if the drugs were outside of the normal distribution channel and permit board to specify the required contents of a pedigree; prohibit the board from requiring the use of an electronic track and trace system for pedigrees until the federal government establishes standard technology; require the board to promulgate administrative regulations to implement requirements consistent with federal law; permit the Board of Pharmacy to issue an order to cease distribution upon cause and permit an administrative hearing on the cease order; and specify penalties for violations.
