Summary of Original Version | Create a new section of KRS Chapter 189 to define terms; establish that automated license plate readers (ALPRs) shall only be used as set forth in this section; ALPRs may be deployed and maintained for the purposes of protecting public safety, conducting criminal investigations, ensuring compliance with law, regulating parking, controlling acess to secured areas, deterring crime and theft, and the Transportation Cabinet's toll collection activities; establish a 90-day data storage limit unless being used for criminal prosecutions or toll collection; prohibit the selling of data obtained by ALPRs and prohibit sharing of data except with law enforcement officers or agencies; require law enforcement agencies and neighborhood associations to adopt and publish a written policy for the use of ALPR systems; amend KRS 189.990 to add a penalty for improper use of an ALPR or captured license plate data. |
